Detective privado

¿Qué es un detective privado?

La definición que mantiene el Tribunal Supremo respecto al detective privado es la de un testigo privilegiado (en todo el procedimiento judicial), siendo una persona física capacitada legalmente para realizar investigaciones confidenciales para personas tanto físicas como jurídicas, cuyas funciones según el artículo 101 del Reglamento de Seguridad Privada son: obtener y aportar información sobre pruebas de conductas o hechos privados de la investigación por encargo, de delitos perseguibles de los legítimos en el proceso penal.

El detective privado es un profesional que generalmente ejerce su labor en la obtención de datos y pruebas que aporta y rectifica ante los tribunales si fuese necesario. No en vano, la Ley de Enjuiciamiento Civil otorga gran importancia a las pruebas e informes emitidos por detectives, que pueden ser ratificadas ante el estamento correspondiente en el procedimiento judicial.
